Terms and conditions of entry
By entering, or purchasing a ticket or paying an entry fee to attend, Cruden Farm, you enter into a contract with the trustees of the Keith and Elisabeth Murdoch Trust ABN 30 707 020 388 (Trust) through their agent or nominee, Cruden Custodian Limited ACN 165 992 790 (Custodian), on the following terms and conditions (Terms).
In these Terms:
- ‘we’, ‘us’ and ‘our’ means the Custodian, the trustees of the Trust (or any of them), and any officers, directors, agents, employees and independent contractors of the Custodian or the trustees of the Trust; and
- ‘you’ means any person who enters Cruden Farm at any time whatsoever or who purchases a ticket or pays an entry fee to attend Cruden Farm.
Where you purchase a ticket or pay an entry fee on behalf of another person, these Terms will also apply to that person. You agree that you make such purchase or payment as that person’s agent and you must ensure that they are aware of and have read these Terms.
Where you are an adult responsible for a minor, dependent or other person accompanying you at Cruden Farm, you agree to these Terms on your own behalf and on behalf of each minor, dependent or other person accompanying you, and you must directly supervise any such person at all times.
Upon your arrival at Cruden Farm you must immediately report to the gatehouse.
You enter, and bring personal property on to, Cruden Farm at your own risk. You accept the risk of injury, loss or damage of any description and howsoever arising at Cruden Farm, including to your person or property and whether as a result of negligence or otherwise.
To the fullest extent permitted by law, and without affecting any rights you have under the Australian Consumer Law or other law which cannot be excluded or modified:
- we disclaim and exclude all liability (including for negligence) for any injury, loss or damage of any description and howsoever arising at Cruden Farm, and whether such injury, loss or damage is direct or indirect, including injury, loss or damage to your person or property, or to that of any minor, dependent, or other person accompanying you, or any person for whom you have purchased a ticket or paid an entry fee to attend Cruden Farm; and
- you agree to release, waive, indemnify and forever discharge us from any liability, claim or demand in respect of any such injury, loss or damage.
Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted by law.
For the avoidance of doubt, and subject to these Terms, a liability of the trustees of the Trust (including for negligence) arising under or in connection with these Terms is limited and can only be enforced against the trustees to the extent to which it can be satisfied out of property of the Trust, and the trustees of the Trust need not pay or otherwise satisfy any such liability out of any other property.
You must, and must procure that any minor, dependent or other person accompanying you, obey all rules and directions displayed within Cruden Farm, comply with any reasonable direction that we give and remain behind all fences and natural barriers.
We reserve the right, in our absolute discretion, to refuse entry or admission to, or to remove any person from, Cruden Farm.
Any provision of these Terms which is void, voidable, unenforceable, illegal, prohibited or otherwise invalid in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or the remaining provisions in that or any other jurisdiction.
